These Terms and Conditions ("Terms") govern your use of the website www.finefragrancecollection.com (the "Website") and the purchase of products from Fine Fragrance Collection (Pty) Ltd (Registration No. 2014/158879/07) ("Fine Fragrance Collection", "FFC", "we", "us" or "our").

By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Website or place an order.

2. WEBSITE ACCESS & DELIVERY TERRITORY

2.1 The Website may be accessed from anywhere in the world.

2.2 We only courier and deliver products within the borders of the Republic of South Africa.

2.3 We do not deliver or courier internationally under any circumstances.

3. ELIGIBILITY

By placing an order, you warrant that:

• You are at least 18 years old; and
• You have the legal capacity to enter into a binding contract.

4. PRODUCTS

4.1 Fine Fragrance Collection sells true generic perfumes directly to customers and registered agents.

4.2 Our products are true generics of original branded perfumes. They are not designer-inspired alternatives.

4.3 All trademarks referenced belong to their respective owners and are used strictly for identification and comparison purposes. Fine Fragrance Collection is not affiliated with, endorsed by, or associated with any brand owner.

4.4 Product availability is subject to stock on hand. We reserve the right to limit quantities or discontinue products at any time.

5. ORDER PROCESS & CONTRACT FORMATION

5.1 Placing an order constitutes an offer to purchase products from us.

5.2 A binding contract is formed once full payment has been successfully received by us.

5.3 We accept all orders for which payment has been received; however, we reserve the right to cancel and refund any order at our discretion, including but not limited to cases of stock limitations, pricing errors, suspected fraud, or operational constraints.

5.4 If an order is cancelled by us, a full refund will be processed in accordance with Section 8.

6. PRICING & PAYMENT

6.1 All prices are displayed in South African Rand (ZAR).

6.2 Prices include VAT unless otherwise stated.

6.3 Prices may change at any time but will not affect orders already paid for.

6.4 Accepted payment methods include Visa, Mastercard, and EFT (where available).

7. DELIVERY

7.1 Delivery is available within South Africa only.

7.2 Estimated delivery time is within 7 working days. Delivery times are estimates only and are not guaranteed.

7.3 Delays may occur due to courier issues, high order volumes, or circumstances beyond our control.

7.4 Risk of loss or damage passes to you upon delivery.

8. RETURNS, REFUNDS & FAULTY PRODUCTS

8.1 All purchases are final. We do not offer a cooling-off period.

8.2 Returns or refunds will only be accepted in the following cases:

• Proven factory fault (including pump/spray nozzle failure during normal use);
• Incorrect product supplied by us.

8.3 In approved cases, return collection costs will be covered by us.

8.4 If a delivery or return collection attempt fails due to the customer being unavailable or not handing over the parcel, any further costs will be for the customer's account.

8.5 We do not accept returns or refunds for:

• Change of mind;
• Ordering the wrong product;
• Preference-based reasons;
• Claims that the perfume smells different from originals or previous purchases;
• Claims that the bottle "feels empty".

8.6 All bottles intentionally contain a visible air gap to prevent spillage during production. Every bottle contains exactly 30ml of perfume.

8.7 All approved refunds will be processed within 7 working days.

9. SCENT & PERFORMANCE DISCLAIMER

9.1 Our perfumes are formulated as true generics and undergo strict internal quality and matching procedures.

9.2 Smell perception and longevity are subjective and may vary due to skin chemistry, environment, health factors, or olfactory fatigue (nose blindness).

9.3 We do not accept returns or refunds based on scent perception, longevity complaints, or claims of variation between bottles.

9.4 We have never changed our perfume oils.

10. INTELLECTUAL PROPERTY

10.1 All Website content is the property of Fine Fragrance Collection or its licensors.

10.2 Registered Agents are permitted to use Website content solely for the purpose of selling Fine Fragrance Collection products as Agents.

10.3 No person may copy, imitate, or repurpose our Website, branding, or materials for fraudulent or misleading purposes, including impersonation.

10.4 Unauthorised use may result in legal action.

11. LIMITATION OF LIABILITY

11.1 To the fullest extent permitted by law, Fine Fragrance Collection accepts no liability whatsoever for any loss, damage, injury, or adverse reaction arising from the use of our products.

11.2 Ingredient and allergen information is provided on the Website. Customers are solely responsible for checking this information prior to use.

11.3 We will not issue refunds or accept returns based on allergic reactions, sensitivities, or misuse.

11.4 Liability, if any, is strictly limited to proven factory faults or incorrect items as outlined in Section 8.

12. DATA PROTECTION & MARKETING CONSENT

12.1 Personal information is processed in accordance with the Protection of Personal Information Act (POPIA).

12.2 By purchasing on the Website and providing your email address and/or phone number, you consent to receiving marketing communications via email and SMS.

12.3 You may opt out at any time using the unsubscribe options provided.

13. AGENT TERMS & CONDITIONS

13.1 AGENT STATUS

An individual becomes an official Fine Fragrance Collection Agent only upon purchasing a starter pack from Fine Fragrance Collection, either in-store or via the official Website.

Starter packs may be pre-selected or built starter packs. Built starter packs must contain a minimum of 30 bottles and include at least 10 different fragrance variants.

13.2 WHOLESALE SHOPS

Wholesale shops sell only to Agents or new Agents purchasing a starter pack and do not sell directly to customers.

13.3 IN-STORE PURCHASE REQUIREMENTS

Agents must be present in person and present valid government-issued identification. The use of another person's ID, buying on behalf of another, account sharing, or third-party purchasing is strictly prohibited.

13.4 STOCK VERIFICATION

Agents must verify quantities and variants before leaving the store. No claims will be accepted thereafter, except for factory faults.

13.5 ADVERTISING RULES

Agents may advertise on their own platforms or groups but may not advertise or sell on Fine Fragrance Collection's official social media pages, nor reply to comments for selling purposes. Sales outreach must occur via private messages only.

13.6 TERMINATION

Fine Fragrance Collection reserves the right to remove Agent status or ban stock purchases at its sole discretion.

13.7 FAKE PRODUCTS & UNAUTHORISED SELLERS

Fine Fragrance Collection is not liable for counterfeit products purchased from unauthorised sellers. Customers and Agents must verify Agents via the Find an Agent page and purchase only from official channels.

13.8 APPLICABILITY

All other Terms apply equally to Agents.

14. FORCE MAJEURE

We are not liable for failure or delay caused by events beyond our reasonable control.

15. VARIATION OF TERMS

We may update these Terms at any time. Continued use of the Website constitutes acceptance.

16. SEVERABILITY

If any provision is found unenforceable, the remaining provisions will remain in force.

17. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Fine Fragrance Collection.

18. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the Republic of South Africa. All disputes are subject to the jurisdiction of South African courts.
